This section provides important information about your rights under the Home and Community-Based Services (HCBS) regulations. It ensures that you are fully informed of your rights as an individual receiving services. By completing this, you acknowledge that you understand your rights, including the right to make decisions about your care and services, as well as the protections available to you. Please review the details carefully and confirm your understanding. We will always stand by you to ensure they are respected and upheld.

Notification of Individual Rights - HCBS

In addition to rights afforded to individuals we support, the final settings rule and HCBS have additional rights in place to protect each individual who receives services and supports under the HCBS umbrella. Each individual has the following additional rights:


  1. Right to live in an integrated setting and access to the greater community.
  2. Right to seek employment, work in competitive settings, engage in community life, control personal resources, and receive services in the community just like others who do not receive waiver services.
  3. Right to select the setting among several options and the right to a private unit.
  4. Right to a setting that is based on needs, preference, and resources available for room and board.
  5. Right to be free from coercion and restraint.
  6. Right to Privacy, Dignity, and Respect.
  7. Right to be independent in making life choices, selecting your own schedule, selecting your activities, and deciding with whom you want to interact daily.
  8. Right to have a choice in who supports you, the type of supports, and the type of services you receive.
  9. Right to have a lease or legally enforceable agreement to have the same protection as tenants of any other property.
  10. Right to Privacy in the sleeping unit.
  11. Right to Locked bedroom doors with a personal key. Only select staff should have access to the bedroom key.
  12. Right to choose who you share a room with if they are not in a private room.
  13. Right to furnish and decorate your sleeping area/room.
  14. Right to control your day and what you participate in.
  15. Right to food at any time.
  16. Right to have visitors at any time.
  17. Right to Come and Go at any time.
  18. Right to have an accessible physical environment.

If any changes, exceptions, or modifications need to be made, an independent third party must assess the need and the need must be documented in the Person-Centered Service Plan. Before a modification is put in place, all the steps required will be explained to you and your support team.
